7 Reasons Why Law Firm Diversity Intiatives Fail

The changing demographics within the United States have signaled to firms that diversity is an important goal that will affect the firms viability and ultimately the bottom line. In response, many firms have launched diversity recruitment efforts designed to bring more women and attorneys of color into the firm. The problem has been that within a few years of being hired attorneys that qualify as diverse leave the firm in search of more inclusive, diverse and culturally competent work environments. Below are some critical reasons why attempts at creating diversity have failed. 1) Lack of Commitment at the top: In order for diversity initiatives to succeed, there must be vigorous support for it at the senior level of the firm or organization. Partners are the change agents of the firm. Committees formed to address issues of diversity, recruitment, retention and cultural competence must be lead by key leaders within the firm. 2) Failure to assess the firms environment: Assessment is critical in helping to create and implement an effective diversity initiative plan. Its critically important to understand an organizations level of development before launching a diversity or cultural competence initiative. Firms must be prepared to assess their hiring practices, overall culture, interpersonal relationships, views about diversity and promotion practices 3) Over emphasis on recruitment and hiring: Relying on recruitment as a primary means of creating diversity will prove to be an ineffective strategy. Instead, recruitment is simply an initial step in the overall process. Firms must ensure that their work environment can support a diverse staff. Next, firm-wide, culturally effective systems and practices must be implemented in order to prevent excessive attrition among women and attorneys of color. Retention and development of a strong and diverse pool of attorneys depends upon the firms ability to create a work environment that values and leverages difference, mentors cross culturally and consistently measures and monitors the progress and development of all attorneys. 4) Failure to include diversity objectives in the organizations strategic plan: Many firms fail to include diversity goals into the firms overall vision and plan for growth and development. Organizational change is a process and in order to successfully reach objectives related to diversity, goals must be included in the firms strategic plan. Firms successful in building a diverse workforce have implemented specific strategies in the areas of hiring, retention, professional development, communication, promotion, mentoring etc. 5) Lack of understanding of diversity phases: Many firms fail to view the creation of a diverse organization as a developmental process. Diversity and cultural competence develops along a continuum. In the early stages of the process, firms need to define diversity, identify problems and opportunities, provide education and awareness, and develop a leadership plan along with the business case for diversity, a clear vision and well defined goals. Finally firms must understand that building a diverse and inclusive work environment is an ongoing effort. 6) Ignoring the importance of training and development: Cultural competence and diversity training with a focus on building awareness and alliances vs. blaming and shaming is critical to creating a productive, diverse and inclusive workforce. Staff must have the opportunity to explore current views and misconceptions around issues of inclusiveness, race, gender, sexual orientation, religion and individuals with physical challenges. Failing to link training and development with firm-wide diversity objectives will result in the firms inability to build an inclusive and diverse organization. 7) Cultural Incompetence: Many firms communicate a desire to build an inclusive and diverse work environment yet they still place a high value on sameness. Whether consciously or subconsciously this value for sameness is communicated to others in the firm. Instead, firms need to develop a high level of cultural competency. Cultural competence requires that organizations: Have a defined set of values and principles and demonstrate behaviors, attitudes, policies and structures that enable them to work effectively cross-culturally. Have the capacity to (1) value diversity, (2) conduct self-assessment, (3) manage, appreciate and leverage the dynamics of difference, (4) acquire and institutionalize cultural knowledge and (5) adapt to diversity and the cultural contexts of their employees and the clients and communities they represent. Think of cultural competence as fertile ground upon which to plant, grow and develop a successful recruitment, retention and firm wide cultural diversity program. Being raised in a Christian home where tradition runs deep, you may find yourself in the midst of a major battle when your heart is given to someone with different beliefs. There is, of course, nothing wrong with dating a non-Christian, just keep in mind that you marry who you date. If this is understood, and you are truly willing to accept and deal with the repercussions, all the more power to you. All we suggest is that you consider a few things before jumping in. What kind of dilemmas would you face in the future? Can a non-Christian help you spiritually, or will they gradually pull you down? It’s easy to compromise your standards and beliefs in order to stay appealing to that person, but is that really being true to yourself? It shouldn’t even be an option to alter everything you’ve based your life around because your beliefs have helped shape you into the person you are, the person that they fell for. Then there’s always the issue of children. What kind of foundation will their lives be built on? Would they be encouraged to attend church and live the principles that you live by, or will they be brought up in the middle of a constant tug-of-war? It general, it just seems to be easier on everyone, especially kids, when both parties follow the same rulebook. Then again, there are those occasional exceptions to the rule. We’ve all heard different stories of Christians dating non-Christians who eventually do turn their lives to God. They later marry and have strong, happy relationships with values centered on Christ. Or, there are those couples that just don’t let religion get in the way. Both are willing to compromise and let the other partner have their freedom to worship and live in a way that suits them. As promising as it sounds, though, it’s not always realistic. Many couples involved in “dual-faith” relationships will find themselves buried in conflict and heartache at some point, causing them to break up or divorce. It’s to be expected that meeting new people, especially people that you’re compatible with, is going to be challenging. But, consider carefully whether short-term gain is worth ending up with the wrong person. Falling in love is easy, but it’s hard to imagine ever voluntarily walking away from the relationship because your partner’s beliefs contradict your own. The bottom line is that it’s up to you who you date, because you’re the navigator of your future. No matter who you end up with, you’re bound to run into problems now and then. That just comes with the territory. From there, it’s up to you what happens. You’ll either choose to stick at it and work through the rough patches, or you’ll decide it’s too hard and back out. If it makes your decision any easier, just remember this advice: when a Christian and a non-Christian jump into a relationship, the scales are uneven and likely to tip! By Jeff Anliker Carpal Tunnel Syndrome (CTS) is the most widely recognized form of Repetitive Strain Injury (RSI), but Trigger Finger is catching up fast, becoming all too common among society and affecting the youth and elderly in ever-increasing numbers. If the rising numbers keep on track, Trigger Finger may be recognized along with Carpal Tunnel Syndrome as having achieved epidemic proportions. Trigger Finger On The Rise Prior to the 1990’s, Trigger Finger seemed to affect a small number of the elderly that had experienced some form of direct trauma or excessive strain to one or possibly several fingers. Trigger Finger was more prevalent in those that were already suffering with Osteoarthritis in the affected hand, making many healthcare professionals to believe that Trigger Finger was a byproduct of Osteoarthritis. But within the past 5-years, the age of those suffering from Trigger Finger became much younger while the overall number of individuals with the disorder increased. The belief of a direct correlation between those suffering with Osteoarthritis and Trigger Finger seems to be reducing in popularity as many of those suffering with Trigger Finger do not have Osteoarthritis, but instead, are involved in high-risk tasks that are already associated as the causative factor in many types of Repetitive Strain Injuries. Injuries resulting from repeated motion (repetitive / cumulative trauma disorders — CTD’s) are growing. According to recent annual statistics from the U.S. Survey of Occupational Injuries and Illnesses, over 302,000 CTD’s account for nearly two-thirds all of workplace-related illnesses. Ergonomic disorders are the fastest growing category of work-related illness. According to the most recent statistics from the U.S. Bureau of Labor Statistics, they account for 56 percent of illnesses reported to the Occupational Safety and Health Administration. Trigger Finger Recognized as a Repetitive Strain Injury Now that Trigger Finger is rearing its head in the workplace with increased intensity, it has been added to the growing list of debilitating Repetitive strain Injuries. Trigger Finger now joins the ranks of Tendonitis, Carpal Tunnel Syndrome, Epicondylitis, Cubital Tunnel Syndrome, DeQuervain’s and the many other debilitating workplace disorders affecting the upper extremity. So, what is Trigger Finger, how is it recognized and what are its symptoms? Trigger Finger Explained Trigger Finger is a form of overuse injury affecting any of the fingers (1-5) with symptoms ranging from a painless annoyance with occasional snapping/jerking of the finger(s), to severe dysfunction and pain with continuous locking of the finger(s) in a flexed downward / forward position into the palm of the hand. The occurrence of this injury usually results from overuse of the flexor muscles/tendons and the formation of an adhesion or fibrotic nodule on the tendon. If left untreated, the adhesion/nodule becomes larger, therefore creating a conflicting ratio between the size of the tendon and the size of the entrance of the tendon sheath. In most cases, if the adhesion/nodule is not treated, it can continue to increase in size (Depending on activity/use of the affected finger) to the point where it still has the ability to pass into and through the tendon sheath when flexing the finger, but becomes stuck and cannot move back through the tendon sheath when trying to extend/straighten the finger, thus causing the finger to lock in the flexed forward / downward position. The Trigger Finger Solution Because Trigger Finger consists of an adhesion, nodule, and scar tissue buildup on the tendon due to excess strain, overuse, or direct trauma to that specific location on the tendon, it should be treated with stretching and strengthening exercises in order to break down the adhesion on the affected tendon. By breaking down the adhesion on the affected tendon, it reduces in size and slides through the pulley system in a normal manner, no longer catching and locking into the downward flexed position. (There is also a thinning of the tendon, which helps reduce the overall size of the tendon and nodule, therefore allowing it to pass through the tendon sheath with greater ease.) Creating strength in the opposing finger extensor tendons is very important as it allows the finger to return to an extended position in a more appropriate manner. This is where muscle balancing comes into play. By creating equality of tendon length and strength on both sides of the finger joint, individuals can help prevent the onset of Trigger Finger and/or keep it from re-occurring in the future. Conservative therapy utilizing stretches and exercises has been highly effective, providing long-term and permanent relief.
